Use of tv and film clips bring home points in dealing with complex issues

There is an art to knowing how and when to bring about a settlement in civil litigation. Illustrating ways in which balance may be found in coming to an agreeable result is frequently the biggest challenge. To demonstrate that notion at the February 11, 2009 luncheon meeting of the East Bay Claims Association, guest speaker Jeff Allen, a partner with the law firm of Van De Poel, Levy & Allen, used comedic video clips from film and TV.

The film “Intolerable Cruelty” provided a good laugh, as George Clooney muddled his way through, transfixed by his client’s soon-to-be ex-wife, botching a settlement negotiation. Allen, and his assistant, Matt, followed that a clip from Seinfeld where Kramer gets burned by hot coffee and winds up jumping at the first settlement offer of free coffee for life, much to the chagrin of his lawyer.
“Face to face negotiation is tough,” Allen stated. “A third party helps to triangulate the discussion,” he added.

Allen also stressed the value of mediation in the settlement process, and explained the differences and uses of mediation, binding and non-binding arbitration.

His talk was brief, but effective and to the point. The bottom-line is really all about trying to bring the parties to where they can come to “yes”.

Earlier in the meeting, East Bay Claims member, and past president Bob Tucknott was the recipient of a prestigious National Safety Excellence Award by Shelby McNamara, of the Association of Building and Contractors. Tuckknott Electric Company was just one of 34 companies in the country to receive this award.

EBCA Rep to the Claims Conference of Northern California, Lisa Winn, announced the newly revised dates for the 16th annual event, September 10-11, 2009 at the Hyatt Regency Downtown Sacramento. She also announced, as Exhibitor Committee CoChair, that exhibitor placement packets are going out to all exhibitors from th e2008 CCNC, with 30 days for them to reserve their spots before remaining displapositions are opened up to all.

Brian Davis, of Restoration Clean-Up Company, is heading up the 2009 EBCA Golf Tournament, and announced that his committee has a whole new plan in store. Stay tuned for more on that soon.
